This information notice is provided pursuant to art. 13 of Regulation EU 679/2016 by the Company FORTI GIORGIO & C. SAS DI Forti Cristian. With registered office in San Giovanni al Natisone, 33048, at 16 Via dell’Artigianato, in its capacity as Data Controller to the users of the website of the company FORTI GIORGIO & C. SAS who fill in the “Contacts” form authorising the Company FORTI GIORGIO & C. SAS to process their personal data.
The provision of data is optional. The refusal to provide the data makes it impossible for us to handle and reply to the requests we receive.

1. Purposes of processing

The personal data provided by the users are used for the exclusive purpose of handling and replying to their requests.

2. Legal basis

The personal data provided by the users are lawfully processed for the fulfilment of precontractual measures or contractual obligations (art. 6 par. 1 point b) of Regulation 679/2016), requested by the users themselves (request sent by filling in the form).

3. Recipients of data

The personal data provided by the users will in no way be disseminated to third parties. They may be disclosed to employees and collaborators of the Controller, who will process them in compliance with the instructions received from the Controller.

4. Data Processor

If needed, for activities connected to the maintenance of the technical part of the site, the personal data provided may be processed by persons tasked with those duties by the company FORTI GIORGIO & C. SAS appointed as data processor pursuant to art. 28 of Regulation EU 679/2016.

5. Storage of data

The users’ personal data will be processed for the period of time that is necessary for the achievement of the purposes mentioned herein.

6. Rights of the data subject

Pursuant to articles 13(2) and 15 to 21 of the Regulation, we would like to inform you that you may exercise the following rights with regard to the processing of your personal data:

a) Right to obtain access to the personal data and to the following information:

  • confirmation as to whether or not personal data concerning you are being processed;
  • the purposes of the processing;
  • the categories of personal data;
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed;
  • if the data were not collected from the data subject, all available information on their source;
  • the existence of an automated decision-making process, including profiling;
  • a copy of the personal data that are being processed.

b) Right to rectification and completion of the personal data;

c) Right to erasure of the data (“right to be forgotten”), where one of the following grounds applies:

  1. the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  2. the data subject withdraws consent on which the processing is based and there is no other legal ground for the processing;
  3. the data subject objects to the processing and there are no overriding legitimate grounds for the processing;
  4. the personal data have been unlawfully processed;
  5. the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.

Where the controller has made the personal data public and is obliged to erase them, it must inform controllers which are processing the personal data that the data subject has requested the erasure of any links to, or copy or replication of, his/her personal data.

d) Right to restriction of processing in case:

  1. the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
  2. the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
  3. the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
  4. the data subject has objected to processing pending the verification whether the legitimate grounds of the controller override those of the data subject.

e) Right to lodge a complaint with the Data Protection Authority for the protection of personal data, following the procedures and instructions published on the official website of the Authority

f) Right to the portability of the data of the data subject or the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and the right to transmit those data to another controller if processing is based on consent or on a contract and is performed by automated means. Where technically feasible, the data subject has the right to obtain the direct transmission of the data from one data controller to another.

g) Right to object at any time to processing of personal data, including, in particular in cases where:

  1. the processing is performed on the basis of the legitimate interest of the controller, with prior explanation of the reasons for objection;
  2. the personal data are processed for direct marketing purposes.

h) Right not to be subject to a decision based solely on automated processing, including profiling, except in cases where the decision: is necessary for the conclusion or the performance of a contract between the data subject and a data controller, is authorised by the law of the EU or of the Member State to which the controller is subject, or is based on the express consent of the data subject.

i) Right to withdraw consent at any time; the data, in the absence of another legal basis (among which the fulfilment of a legal obligation or the performance of a contract) must be erased by the controller.

The exercise of the rights is not subject to any formality and is free of charge.

7. Means of exercising the rights

The data subject may, at any time, exercise the rights by sending:

  • a registered letter with proof of receipt to FORTI GIORGIO & C. SAS, 16 via Dell’Artigianato, 33048 San Giovanni al Natisone Udine ;
  • an e-mail to the address .
